TIG uses a structured approach that takes into account risk assessment and management, educational objectives, fun and engagement when developing and choosing appropriate activities. TIG is committed to consistently redefining and evaluating its operating procedures to ensure that its risk management is at the industry standard or better. TIG is third-party audited for safety by OutdoorsMark New Zealand; The TIG leader : participant safety ratio is 1:15 for general programme activities and 1:8 for technical components; TIG leaders are all certified First Aid responders; Activities have risk assessments and risk mitigation procedures put into place; TIG leaders are trained and assessed as competent for the activities they lead; TIG has a private campsite and can arrange private overnight security personnel; TIG maintains appropriate insurance policies with respect to its activities. Consent and Waiver This form must be completed and signed by each participant, or if the participant is under the age of 18 years, by his/her parent or legal guardian. TIG also reserves the right to request and/or inspect evidence of a participant’s identity, age, fitness and medical condition where TIG deems this necessary for the purposes of its safety and risk management. TIG may refuse participation in any programme/activities to any participant as TIG may in its sole discretion determine. Acknowledgement of Risks and Dangers I/We understand and accept that TIG provides a variety of activities that often include warm-ups, games, group initiative problems, low and high challenge course elements and other rigorous physical adventure activities that may also involve water entry. The level of participation in the programme and activities is at all times completely up to the participant. I/We understand, agree and accept that participation in the programme/activities involves exposure to potential risk of injury (physical and/or emotional) and dangers (foreseeable and unforeseeable) that are inherent in outdoor education, adventure, sport, and generally in the types of activities provided by TIG. TIG strongly recommends that every participant have their own health/accident insurance coverage. TIG also takes out a group personal accident policy for all participants. Each participant’s health / medical information (as required in the Information Form must be made known to TIG for insurance purposes and so that TIG staff are prepared to respond appropriately if the need arises. I/We confirm that the participant is physically, medically and emotionally able to participate in TIG’s programme/activities and there are no reasons, physical, medical or otherwise, why s/he cannot participate. Medical Information I confirm that the above medical information is complete and accurate. If there are any changes to the above medical information or my child’s medical status, I will notify Treasure Island Ltd (“TIG”) immediately. I understand that TIG will rely on this information, and TIG is not liable in any respect whatsoever as a result of the medical information being incomplete or inaccurate. I understand that in case of an emergency or need for medical treatment, TIG will attempt to contact the Emergency Contact to inform them of the situation at the earliest practicable opportunity. Notwithstanding this, I hereby authorise TIG to take such action and/or to provide any medical treatment deemed necessary by TIG in case of any injury, need for medical treatment or other emergency in respect of the participant. Personal Information I/We acknowledge and agree as follows: TIG may collect my/our personal information and the participant’s personal information, and use and maintain such personal information for the purpose of providing the programme/activities and for TIG’s safety and risk management procedures; If I/we do not provide the personal information referred to above, the participant may not be permitted to participate in the programme/activities; TIG may disclose such personal information to any doctor, medical personal or other persons deemed necessary by TIG in case of any injury, need for medical treatment or other emergency, and to TIG’s insurers for insurance purposes; Where I/we provide contact details of a third party in case of emergency, I am/we are responsible for informing the third party of the purpose of the collection of his/her contact details and for obtaining his/her consent to such collection before providing such details to TIG. Waiver In consideration for the opportunity of the participant to participate in TIG’s programme/activities, I/We hereby to the fullest extent lawfully permitted waive and release TIG, TIG’s employees, agents and other representatives from any and all liabilities, claims, actions and rights of any nature whatsoever whether arising in contract, tort, misrepresentation, restitution or otherwise that may arise as a result of the participant participating in TIG’s programme/activities. I/We hereby agree that in the event of any liability on TIG’s part to us/me, TIG’s total liability whether in contract, tort, misrepresentation, restitution or otherwise arising in connection with the programme/activities shall be limited to the amount of TIG’s insurance cover. Adverse Weather Conditions TIG monitors the Hong Kong Observatory website (www.hkobservatory.com) for real time weather information but due to Hong Kong’s mountainous geography, microclimates exist around the region, meaning that local weather conditions may differ from those posted on the internet. Decisions regarding camp programme activities and operations in inclement weather will be made by TIG’s Programme Manager. Rain and Rainstorms – Information about rain and rainstorms around Hong Kong are shown on the Hong Kong Observatory website. See http://www.weather.gov.hk/wservice/warning/rainstor.htm for an explanation of Hong Kong’s rainstorm warning signals. The Programme will continue as scheduled in rain unless there is a safety concern for the activity, in which case TIG may run contingency activities which may be indoor or outdoor activities, as TIG shall deem suitable. Prior to the start of the Programme If there is Amber or Red rainstorm warning, the Programme will continue as scheduled with such modifications as TIG may consider necessary for the actual weather conditions at operating site. If there is a Black rainstorm warning or the Black rainstorm warning is forecast and TIG decides to postpone or cancel the Programme, the Postponement and Cancellation policy shall apply. During the Programme If there is Amber or Red rainstorm warning, the Programme will continue as scheduled with such modifications as TIG may consider necessary for the actual weather conditions at operating site. If there is a Black rainstorm warning or the Black rainstorm warning is forecast and TIG decides to postpone or cancel the Programme, all groups will be sent home where practicable, or returned to TIG’s base or other base to take shelter. The Postponement and Cancellation policy shall apply. Thunderstorms – Information about thunderstorm and lightning around Hong Kong are shown on the Hong Kong Observatory website. TIG will continue as scheduled when localised or intermittent thunderstorms away from TIG’s operating areas are occurring or predicted. If there is less than a 12-second delay between the flash of lightning and the thunderclap, TIG Leaders will move Participants to safety and run contingency activities, and regular scheduled Activities will resume when the thunderstorms subside. Typhoons – Typhoon tracks around Hong Kong are shown on the Hong Kong Observatory website. See http://www.hko.gov.hk/publica/gen_pub/tcws.pdf for an explanation of Hong Kong’s typhoon warning signals. Prior to the start of the Programme Where a T1 or T3 signal is hoisted, the Programme will continue as scheduled with such modifications as TIG may consider necessary for the actual weather conditions at operating site. Where a typhoon is approaching Hong Kong close enough that a T8 signal will be hoisted, and TIG decides to postpone or cancel the Programme, the Postponement and Cancellation policy shall apply. During a programme Where there a T1 or T3 signal is hoisted, the Programme will continue as scheduled with such modifications as TIG may consider necessary for the actual weather conditions at operating site. Where the T8 signal is to be hoisted, and TIG decides to postpone or cancel the Programme, all groups will be sent home where practicable, or returned to TIG’s base or other base to take shelter. The Postponement and Cancellation policy shall apply. Air Quality – When the Hong Kong Observatory issues an API >= 100 for stations closest to TIG operating areas, TIG will substitute less strenuous or indoor contingency activities. Water quality – Where the LCSD lifeguard station or Hong Kong Observatory issues a water quality warning for a TIG operating area, TIG will substitute dry land contingency activities. Notwithstanding any inclement weather conditions, TIG shall be entitled to proceed with the Activities with such adaptations and/or substitute activities as TIG may deem necessary. TIG reserves the right to postpone or adjust any Activities or the Programme due to severe weather or other conditions to protect the safety of the Partcipants. In the event of heavy rain or lightning, rain contingency programming will be substituted for the planned activities. TIG may make changes, cancellations, or substitutions to the Programme for any reason whatsoever including, but not limited to, insufficient enrolment, emergency or changed conditions, or other circumstances beyond TIG’s control which may affect the Programme. TIG will make every attempt to follow the Programme itinerary but TIG reserves the right to alter the itinerary before or during the Programme.
