TREASURE ISLAND LTD. ("TIG") – SAFETY AND RISK MANAGEMENT

Safety and Risk management at Treasure Island is top priority and therefore is externally audited under British Standards – BS 88848:2014. TIG is committed to providing a safe learning environment for the participants. TIG uses a structured approach that considers risk assessment and management, educational objectives, fun, and engagement when developing and choosing appropriate activities. TIG is committed to consistently redefining and evaluating its operating procedures to ensure that its risk management is at the industry standard or better.

  • The TIG leader: participant safety ratio is 1:15 for general camp activities and 1:8 for technical components.
  • TIG leaders are all certified Basic First Aid responders.
  • Activities have risk assessments and risk mitigation procedures put into place.
  • TIG leaders are trained and assessed as competent for the activities they lead.
  • TIG has a private campsite and can arrange private overnight security personnel.
  • TIG maintains appropriate insurance policies with respect to its activities.

CONSENT AND WAIVER

This form must be completed and signed by each participant, or if the participant is under the age of 18 years, by his/her parent or legal guardian.

I/We confirm that all information provided about the participant is complete and accurate. TIG reserves the right to request additional information. TIG also reserves the right to request and/or inspect evidence of a participant’s identity, age, fitness and medical condition where TIG deems this necessary for the purposes of its safety and risk management. TIG may refuse participation in any programme/activities to any participant as TIG may in its sole discretion determine.

ACKNOWLEDGEMENT OF RISKS AND DANGERS

I/We understand and accept that TIG provides a variety of activities that often include warm-ups, games, group initiative problems, low and high challenge course elements and other rigorous physical adventure activities that may also involve water entry. The level of participation in the programme and activities is always completely up to the participant.

I/We understand, agree and accept that participation in the programme/activities involves exposure to potential risk of injury (physical and/or emotional) and dangers (foreseeable and unforeseeable) that are inherent in outdoor education, adventure, sport, and generally in the types of activities provided by TIG.

TIG strongly recommends that every participant have their own health/accident insurance coverage. TIG also takes out a group personal accident policy for all participants. Each participant’s health / medical information (as required in the Information Form must be made known to TIG for insurance purposes and so
that TIG staff are prepared to respond appropriately if the need arises).

I/We confirm that the participant is physically, medically, and emotionally able to participate in TIG’s programme/activities and there are no reasons, physical, medical or otherwise, why s/he cannot participate.

WAIVER

In consideration for the opportunity of the participant to participate in TIG’s programme/activities, I/We hereby to the fullest extent lawfully permitted waive and release TIG, TIG’s employees, agents, and other representatives from any and all liabilities, claims, actions and rights of any nature whatsoever whether arising in contract, tort, misrepresentation, restitution or otherwise that may arise as a result of the participant participating in TIG’s programme/activities.

I/We hereby agree that in the event of any liability on TIG’s part to us/me, TIG’s total liability whether in contract, tort, misrepresentation, restitution or otherwise arising in connection with the programme/activities shall be limited to the amount of TIG’s insurance cover.

USE OF PARTICIPANT IMAGES

I/We permit TIG to use and/or reproduce all images or testimonials of/or relating to the participant whether taken or provided by me/us during or after the programme for marketing purposes. I/We understand that TIG will not give or sell images to any outside agency or organisation without my/our consent.

CONSENT TO PARTICIPATE

I/We understand and agree that the participant must commit to making every effort to prepare and participate in the programme / activities in such a way as to limit the risk of injury to themselves and others.

I/We irrevocably and unconditionally consent to the participant participating in TIG’s programme / activities.

PERSONAL INFORMATION

I/We acknowledge and agree as follows:

  • TIG may collect my/our personal information and the participant’s personal information, and use and maintain such personal information for the purpose of providing the programme/activities and for TIG’s safety and risk management procedures;
  • if I/we do not provide the personal information referred to above, the participant may not be permitted to participate in the programme/activities;
  • TIG may disclose such personal information to any doctor, medical personal or other persons deemed necessary by TIG in case of any injury, need for medical treatment or other emergency, and to TIG’s insurers for insurance purposes;
  • where I/we provide contact details of a third party in case of emergency, I am/we are responsible for informing the third party of the purpose of the collection of his/her contact details and for obtaining his/her consent to such collection before providing such details to TIG.

TERMS AND CONDITIONS:

PREPARATION AND BEHAVIOUR

I/We agree that I am / we are responsible for ensuring that the participant carries all required prescribed medication, appropriate clothing, and equipment for participation in TIG’s programmes/activities. I/We certify that I/we will read the packing list provided by TIG carefully and the participant will arrive at camp fully prepared.

I/We understand that we must ensure that participants have an appropriate backpack, appropriate shoes for dry and wet activities, provisions for hot (sun hat, sunscreen) and cool weather, and a shatter-proof water bottle (minimum 1 litre in capacity). TIG requires participants to abide by TIG’s standards of conduct and behaviour including, without limit, the following rules:

  1. Always listen and take note of briefings given by TIG leaders at the start of each activity.
  2. Always obey instructions from TIG staff regarding participating in TIG activities.
  3. Do not climb trees or rocks, go into water, jump from elevation, light fires, or remove safety equipment, without the express permission and supervision of instructors.
  4. Do not push, bump, or fight with others.
  5. Do not misbehave.
  6. Do not damage property or cause harm to others.
  7. Do not conduct or participate in any illegal activities.

I/We acknowledge and agree that a breach of these rules may result in a participant being refused participation in the programme/activities and/or removed from TIG’s premises.

PROGRAMME AND ACTIVITY TERMINATION, POSTPONEMENT AND ALTERATIONS

TIG reserves the right to terminate, postpone, amend and/or vary any programme/activities for various reasons including, without limit, adverse weather and for safety reasons. TIG may also refuse participation in the programme/activities to any person which TIG, in its sole discretion, determines to be incapable of meeting the rigors or requirements for participating in the programme/activity.

ENGLISH LANGUAGE VERSION SHALL PREVAIL

If this document is translated into any language other than English, the English language version shall prevail in the event of any inconsistency or discrepancy in the documents.

GOVERNING LAW

This document and any disputes relating to this document shall be governed by the laws of Hong Kong and the parties irrevocably submit to the exclusive jurisdiction of the courts of Hong Kong.
